This Master Terms & Conditions page explains the rules and policies governing your access to and use of marina facilities, services, and websites operated by TopSide Marinas and Bay Marine Chicago. These terms apply to all visitors, guests, vessel owners, and users of our digital platforms. By accessing or using any marina facility or website, you agree to be bound by these Terms. 1. Marina-Specific Application
Although TopSide Marinas owns and operates many individual marinas, each Marina maintains its own rules, rates, agreements, waivers, and policies.

2. Use of Marina Facilities
Use of Marina facilities is subject to:
- All posted rules, safety requirements, and applicable laws
- Safe and responsible vessel operation
- Proper use of docks, slips, fueling systems, electrical hookups, and waste facilities
The Marina reserves the right to refuse service, suspend access, or require removal of any person or vessel for safety concerns, non-payment, or rule violations.
3. Assumption of Risk & Waivers
Marina activities involve inherent risks, including but not limited to water conditions, weather, vessel movement, equipment operation, and interaction with other vessels and guests.
By using Marina facilities or participating in Marina activities, you:
- Acknowledge and assume all inherent risks, and
- Agree to comply with any separate waivers or releases of liability required by a specific Marina, service, event, or activity
Execution of a Marina-specific waiver does not limit the applicability of these Terms.
4. Vessel Responsibility & Insurance
All vessels and personal property are brought onto Marina property at the owner’s sole risk.
Unless expressly stated otherwise in writing:
- The Marina does not provide insurance coverage for vessels, equipment, or personal property
- Vessel owners are responsible for maintaining adequate insurance, including liability coverage
The Marina may require proof of insurance as a condition of service.
5. Reservations, Payments & Transactions
Reservations, slip rentals, storage, and other services may be booked online or in person and are subject to:
- Marina-specific rates and availability
- Payment, deposit, cancellation, and refund policies
Failure to pay required charges may result in cancellation, service suspension, or vessel removal, as permitted by law.
6. Website & Digital Services
Marina websites and digital tools are provided “as is” and “as available.” We do not guarantee:
- Continuous or uninterrupted access
- Accuracy or completeness of online content, rates, or availability
We may modify or discontinue website features or online services at any time without notice.
7. Prohibited Conduct
Unless expressly authorized in writing, the following are prohibited:
- Commercial or charter activity
- Unauthorized subleasing or transfer of slips or vessels
- Illegal, unsafe, or environmentally harmful conduct
- Interference with Marina operations or misuse of digital systems
8. ADA & Accessibility
TopSide Marinas is committed to providing reasonable access to Marina facilities and digital services in accordance with applicable accessibility laws, including the Americans with Disabilities Act (ADA).
Due to the nature of marina environments, not all areas or services may be fully accessible. Guests requiring accommodations are encouraged to contact the Marina office in advance so reasonable efforts can be made.
9. Intellectual Property (Websites)
All website content — including text, graphics, logos, images, and software — is owned by or licensed to TopSide Marinas and may not be copied, reproduced, or distributed without written permission.
10. Limitation of Liability
To the fullest extent permitted by law, TopSide Marinas and its affiliated marinas shall not be liable for indirect, incidental, consequential, or special damages arising from:
- Use of Marina facilities
- Participation in Marina activities
- Use of Marina websites or digital services
11. Indemnification
You agree to indemnify and hold harmless TopSide Marinas, each Marina, and their owners, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your vessel
- Your conduct or use of the Services
- Your guests, crew, or invitees
12. Privacy
Use of Marina websites and online services is subject to the applicable Privacy Policy, which governs the collection and use of personal information.
13. Governing Law
These Terms are governed by the laws of the state in which the applicable Marina is located, without regard to conflict-of-law principles.
